TERMS AND CONDITIONS OF SERVICE

Welcome to the website bloomsandblends.com, operated by LETS BLOOM, S.A. DE C.V. (hereinafter, “the Merchant”). This document sets out the terms and conditions (hereinafter, “Terms and Conditions”) applicable to the use of the website, as well as the products and services offered. By browsing the site or making a purchase, the USER declares to have read, understood, and accepted these Terms and Conditions in full.

1. The Merchant reserves the right to modify, update, interrupt, or cancel at any time, without prior notice, the content, products, services, configuration, or presentation of the website. The Merchant also holds all intellectual and industrial property rights over the website and its elements, including source code, logos, trademarks, designs, images, audios, videos, and visual structures.

2. For security reasons, the Merchant may restrict, suspend, or cancel access to accounts in which improper or fraudulent use is detected. The USER guarantees that all information provided for registration, invoicing, or purchase is truthful. By confirming a purchase, the USER expressly agrees to the corresponding payment of the acquired items.

3. The USER agrees to use the site legally, ethically, and respectfully. The use of any software, script, or tool that interferes with, damages, or alters the functionality of the site is prohibited.

4. To make online purchases, the USER must enter debit or credit card details, or any other accepted payment method, as well as the necessary delivery information.

5. The Merchant may remove any comment or content generated by users that, in its opinion, infringes third-party rights, violates legal provisions, promotes discrimination, threatens public order, or is not suitable for the site environment.

6. The site is intended exclusively for adults under Mexican law. By using the site, the USER declares to be of legal age and to have legal capacity to contract. The Merchant is not responsible for use of the site by minors.

7. By providing personal data (name, address, phone, etc.), the USER does so voluntarily in order to facilitate contact, product delivery, promotions, and improved customer experience. Estimated delivery times are 7 to 10 business days; if delays occur due to external causes, the USER will be notified.

8. Sales are final, and no returns or exchanges are accepted, except in the following cases communicated within 48 hours of delivery: expired product, damaged product (broken packaging or spilled), error in the delivered product, or missing item from the order. In such cases, the USER must visit the Merchant’s facilities or contact the Merchant to receive attention within 5 business days. The return must be made in the same packaging and conditions as delivered, including all product components. Costs shall be borne by the USER.

If replacement is approved, it will be made within 20 days of approval. Claims must include photographs, order number, batch number, and, if necessary, video or other evidence. Returns of opened or used products or those stored incorrectly will not be accepted.

The USER is responsible for being available to receive the order. If delivery fails due to USER fault, they will bear the reshipping costs. If the product is destroyed by the shipping company due to failed delivery, the loss will be the USER’s responsibility.

For international orders, any inspection, retention, or delay by customs authorities will not be attributable to the Merchant. If the USER provides an incorrect address, the Merchant will not be responsible. Once confirmed, the order cannot be modified or have items added. Orders with cash payment must be settled within 3 business days; otherwise, they will be canceled.

9. Each skin type is different and may react differently to ingredients or active agents. It is recommended to carefully read the instructions for each product. In case of adverse reaction, discontinue use and consult a physician.

10. The Merchant reserves the right to take legal action in case of improper use of the website, its content, products, or services, or in case of breach of these Terms and Conditions. Any dispute shall be resolved under Mexican law and submitted to the jurisdiction of the competent courts of Saltillo, Coahuila de Zaragoza.

All sales are deemed to take place in Mexico and are governed exclusively by Mexican law. Products comply with Mexican regulations. It is the buyer’s responsibility to ensure compliance with any applicable local, state, or federal requirements in the United States. Any dispute shall be resolved before the competent courts of Saltillo, Coahuila, Mexico.
